TERMS AND CONDITIONS OF SERVICE AND USE

We, SPECTRUM SEVEN OVERSEAS, a Company incorporated under the Companies Act, 2013 and having its registered office at 9-4-84/2, Kakatiya Nagar, Near Mehdipatnam, Golconda, Hyderabad, Telangana 500008, India, hereinafter referred to as the “Company” (where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors, and assigns).

The Company is committed to ensuring the privacy, security, and integrity of your use of its services and the protection of your personal and sensitive information. This document sets out the Terms and Conditions of Use and Service for our platform and services associated with medical tourism and specialty diagnostics.

DEFINITIONS

“We”, “Our”, “Us” shall mean and refer to the Company and/or its platform as the context may require.

“You”, “Your”, “User”, “Client”, “Patient” shall refer to any natural or legal person using the services provided by the Company and who is competent to enter into binding legal contracts under Indian law.

“Platform” refers to any digital or physical interface created or managed by the Company to facilitate its services, including websites, mobile applications, and direct consultation channels.

“Services” shall refer to all services provided by the Company, including but not limited to:

“Healthcare Partners” shall refer to third-party hospitals, clinics, diagnostic centers, doctors, wellness centers, spas, and gyms listed or coordinated through the Platform.

“Third Parties” include any application, company, person, or service provider other than the User or the Company, involved in the provision of the Services, including travel agencies, insurance providers, payment gateways, etc.

REGISTRATION

Registration is not mandatory for users wishing to browse or learn about the Platform and its offerings. However, to access and avail any of the Services, Users must register on the Platform.

Members may register using their email or mobile number and are also provided an option to link their Facebook or Google accounts for a seamless registration experience.

Registration is only permitted for individuals who are above the age of 18 years and legally competent to enter into a contract. If you are a minor, you may use the Platform only through a legal guardian. The Company reserves the right to suspend or terminate any account upon discovering that the User is a minor or otherwise ineligible.

Users are solely responsible for maintaining the confidentiality of their login credentials. Any activity under the account will be deemed to be performed by the account holder. In case of unauthorized use, Users must notify the Company immediately.

If the Company has reasonable grounds to believe that a User has provided false or misleading information, it reserves the right to suspend or permanently terminate the User’s account.

PLATFORM OVERVIEW

The Platform is an aggregator that connects Users with hospitals, doctors, clinics, diagnostic centers, and wellness providers. The following services are offered:

1. Booking Appointments

Users can book consultations with listed doctors/surgeons by selecting a time slot and confirming with their contact information. Appointments are subject to availability.

2. Ask Your Expert Opinion

Users may submit medical queries to be answered by healthcare professionals. This feature is purely for informational purposes. The Company does not endorse or verify any medical advice provided.

3. Get Quotations

Users can request estimated treatment or surgery quotations from various healthcare partners in their selected city. Final costs may differ based on specific patient needs and treatment plans.

4. Diagnostic Facility

The Platform facilitates access to diagnostic services recommended by partnered doctors. The Company is not involved in the sample collection, testing, or validation of results.

5. Online Consultation

Users can book short-duration (10–15 minutes) online consultations with doctors. The Company is not liable for consultation content or any connectivity issues during the session.

6. Treatment Packages

The Platform offers customizable treatment packages based on the User’s needs.

7. Health Check Packages

Health check packages from listed clinics, hospitals, and diagnostic centers are available for booking.

8. Wellness Packages

The Platform also offers spa and massage wellness packages.

Note: The Company functions purely as a facilitator and is not responsible for any adverse medical outcomes, injuries, or legal issues. All liability lies with the treating hospital, clinic, or healthcare professional.

Services outside the scope of the selected package must be paid for directly at the service location by the User.

GENERAL TERMS

1. Binding Nature

The use of the Platform and the Services provided by the Company is subject to these Terms and Conditions, the Privacy Policy, and any other guidelines/policies that may be introduced by the Company from time to time. Continued use of the Platform or Services indicates your acceptance of these Terms.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement under applicable law to access or use our Services.

2. No Medical Advice

The Company is not a healthcare provider and does not provide medical opinions, diagnoses, or treatments. All healthcare services are delivered solely by independent Healthcare Partners. The Company acts as a facilitator and shall not be held liable for any medical outcome.

6. Amendments

The Company reserves the exclusive right to amend, modify or update these Terms at any time. Changes shall become effective immediately upon being posted on the Platform. Continued use of the Services post such changes constitutes acknowledgment and acceptance.

7. License and Access

Subject to compliance with these Terms, the Company grants a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal and non-commercial purposes.

Limitation of Liability

The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform or Services. The responsibility for medical services, advice, or procedures lies solely with the healthcare providers.

8. Termination

The Company reserves the right to suspend or terminate access to the Platform or Services at its sole discretion, without prior notice, for breach of these Terms or any applicable law.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana.

CONTENT

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, brand names, descriptions, sounds, music, and artwork (collectively referred to as “Content”) made available on the Platform are either generated or provided by the Platform. The Company exercises reasonable control and oversight over the Content and strives to ensure its quality, accuracy, integrity, and reliability.

However

Users, doctors, clinics, hospitals, wellness centers, and spas are solely responsible for the content they upload to the Platform. This includes but is not limited to profile information, hospital details, or specific user queries.

In case of any dispute concerning the originality or authenticity of such content, the individual or entity uploading said content shall bear full responsibility and indemnify the Company from any resulting claims or damages.

All Content displayed on the Platform is subject to copyright and may not be reused or repurposed by any individual or third party without the express prior written consent of the Company and/or the original copyright holder.

The Platform assumes no liability for the comments or feedback provided by Members, nor does it verify the accuracy or appropriateness of such content.

The Platform reserves the right to suspend or terminate any Member’s account found to have submitted false, misleading, or offensive content. The offending Member shall be responsible for any legal or financial consequences thereof.

Members are granted a personal, non-exclusive, non-transferable, revocable, and limited license to access the Content on the Platform. No Content may be copied, modified, or reproduced without the written permission of the Company.

CUSTOMISATION OF PACKAGE

Users are offered the flexibility to customize medical treatment packages through the Platform based on their specific requirements. The following terms apply:

These Terms shall constitute a valid and binding agreement between the User and the Company and remain in effect for as long as the User continues to access or use the Platform and its Services.

TERMINATION

The Company retains the right, in its sole discretion, to terminate any User’s access to the Platform at any time and without cause or prior notice.

The Platform may deny access to particular Users to safeguard the interests of the Platform or other Users.

Access privileges may be limited or changed without prior notification, and new features may be introduced at the Platform’s discretion.

Users remain bound by these Terms even post-termination, and may not independently terminate these Terms unless their use of the Platform has ended.

COMMUNICATION

By registering or using the Platform and providing contact details, Users expressly consent to receive communications from the Company via phone, email, SMS, or any other means.

Users can contact to report any discrepancies regarding the Platform or its content. The Company will conduct an investigation and take corrective action as needed. Resolution time will vary based on the nature of the issue.

Users acknowledge that communication from the Company or its representatives is permitted for service-related purposes, including follow-up or feedback, and waive any future harassment claims in this regard.

All data and communications are subject to the Company's Privacy Policy.

PAYMENT

Charges

Registration is currently free. However, to avail any services, Users must make payment directly to the Company using one of the accepted modes:

A processing charge of 3% will be added to all payments, and Users agree to this additional cost.

Users are solely responsible for the correctness of payment credentials. The Company shall not be liable for any issues resulting from incorrect or fraudulent payment details.

Payments are processed through third-party gateways and are subject to their respective terms and conditions.

If payment is deducted but the transaction fails, the deducted amount will be refunded to the User’s account within 7 working days.

FINAL PROVISIONS

These Terms constitute the entire agreement between the User and the Company concerning the use of the Platform and supersede all prior communications. If any provision is found to be invalid, the remaining provisions will remain in full force and effect.

MEMBER OBLIGATIONS AND FORMAL UNDERTAKINGS AS TO CONDUCT

1. MEMBER REPRESENTATIONS

The User agrees and acknowledges that they are a restricted Member of this Platform and that they:

Agree to provide genuine credentials during the registration process. The use of fictitious identities is strictly prohibited. The Company shall not be held liable for any incorrect information provided by the Member.

Agree to ensure that their Name, Email Address, Postal Address, Mobile Number, and any other account-related information remain valid and updated. These details may be edited through the Member's profile settings.

Accept sole responsibility for maintaining the confidentiality of their account credentials. Members must report any unauthorized use immediately. The Company reserves the right to suspend or terminate accounts at its sole discretion.

Acknowledge that data submitted is manually entered into the Platform’s database for the purpose of reference and service optimization.

Authorize the Platform to process and use personal data and published content for personalization, marketing, and service optimization purposes.

Understand and agree that the Platform/Company is not liable for any damages, direct or indirect, arising from the use of the Platform or its Terms of Use, to the fullest extent permitted by law.

Agree not to reproduce, alter, reverse-engineer, distribute, publish, or exploit any content from the Platform without express written permission.

Agree to access the Platform only through its official interface. Any attempt to bypass security, use bots, crawlers, or otherwise access data unauthorizedly will result in suspension or termination.

Accept that offensive or objectionable content may exist on the Platform. The Company disclaims liability for such content but permits users to report the same.

Acknowledge that content generated by Members is not owned by the Company, which assumes no responsibility for it. The Company retains discretion to remove reported content.

Understand that the Platform serves as an aggregator and bears no responsibility for medico-legal issues related to services availed. Such liabilities rest with the respective hospitals or medical practitioners.

Agree to pay for services not covered under any availed package directly at the facility.

Consent to adhere to the terms and policies of third-party Vendors affiliated with the Platform.

2. MEMBER RESTRICTIONS

Members further undertake not to:

Interfere with or disrupt access to the Platform or its services.

Impersonate another person or misrepresent affiliations.

Breach or test the security of the Platform or connected networks.

Use the Platform for any unlawful or unauthorized purposes.

Violate applicable laws, guidelines, or the Platform’s Terms and Privacy Policy.

Damage the Company’s relationship with ISPs or other service providers.

7. DISCLAIMER OF WARRANTIES

The Platform is used at the Member’s own risk.

The Company disclaims all warranties regarding the accuracy, reliability, or uninterrupted availability of the Platform.

No guarantees are offered for third-party content or services linked to or hosted by the Platform.

8. JURISDICTION

All legal claims and proceedings shall fall under the jurisdiction of the courts in Tiruvallur, Tamil Nadu, India.

9. FORCE MAJEURE

The Company shall not be held liable for failure to fulfill obligations due to events beyond its control, including but not limited to natural disasters, war, cyber-attacks, system failures, and acts of God.

10. DISPUTE RESOLUTION

Disputes shall be resolved using the following ADR mechanism:

Mediation: Parties will attempt amicable resolution within 30 days of a written dispute notice.

Arbitration: If unresolved, disputes shall be referred to a sole arbitrator appointed by the Company. Arbitration will take place in Kochi, Kerala, India, in English. The arbitrator's decision shall be binding.

11. MISCELLANEOUS

Entire Agreement: These Terms and the Privacy Policy constitute the complete agreement.

Waiver: A failure to enforce any clause does not constitute a waiver of future enforcement.

Severability: If any part is held unenforceable, the rest remains in effect and will be adjusted to best reflect the original intent.
